Note A: Where a development is not connected to a public water supply or a public sewer, the relevant development charge will not apply for the provision of such service.

Note B: A Special Development Contribution Development, in accordance with Section 48 (2) (c) and Section 48 (12) of the Planning and Development Act 2000, will be required in respect of the following developments:-

(i) development consisting of a change of use which is likely to substantially increase the demand for water, or increase the amount of effluent, or adversely change the nature of the effluent, based on the specific nature of the change of use, and

(ii) development, which of its nature requires specific road improvement of other public infrastructural development, in whole or in part to cover such work.

Note C: The level of Contribution payable under the Scheme will be increased from January 1st2009 and annually thereafter, (unless previously discharged), in line with the Wholesale Price Index for Capital Goods, Building and Construction, as published by the Central Statistics Office unless the Scheme is superseded by a further Development Contribution Scheme adopted by the Council.

AREA TO WHICH THE SCHEME RELATES

The schemes shall apply to the functional area of Kerry County Council exclusive of the three Town Councils. In the preparation of the Environs Plans for Tralee/Killarney and Listowel the contributions scheme will be re-examined in the context of the special needs of these areas and their relationship with the adjoining Town Council.

REVIEW OF THE SCHEME

The Scheme may be reviewed from time to time by the Council having regard to circumstances prevailing at the time. After a review of the Scheme, a new Scheme may be made. The scheme shall expire on 31st December, 2010 unless a new Scheme is made before then. A new scheme will be made not later than 31st December, 2010.
