DEVELOPMENT CONTRIBUTIONS – SCHEDULE OF CONTRIBUTIONS *

The following is the schedule of General Development Contributions adopted by Waterford County Council for 2008.  On January 1st of each year from 2009-2012, these charges will be subject to a cumulative increase of 11.5% as well as the inflationary increase outlined in Section 10.1.

C. Pending the full introduction of the Government Water Pricing Framework, the following levies per sq m will apply to industrial / commercial developments:

Water Supply: €6.76

Waste Water: €6.76

D. Where car parking provisions in accordance with the requirements of the County Development Plan are not fully provided on site, and where the proposed development is availing of car parking facilities existing, or to be provided by Waterford County Council, a rate of €2,545 (€7,351 in Tramore, Dungarvan and Dunmore East) per space will apply. 

E. Where public lighting is required on public roads to facilitate any development a levy of €2,300 will be applied per light required.

F. Any development for which the Local Authority incurs exceptional costs in the provision of necessary infrastructure facilitating the development and which are not covered under the General Contribution Scheme, will be subject to contributions under the Special Development Contributions section of the Scheme.

G. A caravan park will be recognised as a commercial development which will be charged as follows:

Each unit will be charged as equivalent to a 50m² commercial development (i.e. €425 for roads; €425 for Community: €495.50 for Storm Water). Pending the full introduction of the Government Water Pricing Framework, the following levies will also apply: Water Supply: €425; Waste Water: €425.

H. An individual mobile home will be recognised as equivalent to a 50m² residential development and will be levied accordingly

I. Other applications not covered above will be dealt with on a case by case basis. Any developments not specifically referred to in the scheme will be charged at a rate which is deemed most appropriate. The basis for determination will be the rate for developments which are listed in the scheme and are deemed closest in nature to the proposed development

Exemptions:

Under subsection 3(c) of Section 48 of the Planning and Development Act 2000, a Development Contribution Scheme may allow for the payment of a reduced contribution or no contribution in certain circumstances.  Accordingly, a development contribution shall not apply in the following instances:

Development carried out in accordance with Section 179 of the Planning and Development Act 2000 (as amended) (i.e. Local Authority Development).

Development being carried out in accordance with Article 157(1) and (2) of the Planning and Development Regulations 2001.  (Development which is statutorily exempt from planning fees).

Agricultural development which is deemed necessary to comply with the Nitrates Directive 91/676/EEC as certified by an agricultural advisor/agricultural consultant/ agricultural engineer and where appropriate, by a supervising Officer.

Restoration/refurbishment of buildings on the Record of Protected Structures to attract a 50% reduction, if such restoration/refurbishment adheres to good principles of conservation.

Developments for which a Disabled Persons Grant is paid to be fully exempt.

It should be noted that

In the case of a change of use, changes of use will only attract development contributions if the use results in an increase in service use. Only the increase in use will be charged for. In cases of refurbishment / changes of use, development contributions applicable on the date of the planning decision will apply.

* Clarifications: 1. For buildings, gross floor area is, in general, the sum of floorspace within the external walls of the buildings, excluding plant and tank rooms and car parking areas. Exceptions may occur where development is undertaken outside the external walls e.g. roof-top development. 2. With regard to the contributions to be charged at different threshold levels (e.g. >150m²), these levels will apply on a per unit basis for residential developments and on a per application basis for industrial/commercial/agricultural developments. 3. “Where applicable” means where public water infrastructure is accessible to a development, whether or not a developer decides to connect to the infrastructure
